The big problem is, how do you enforce a change in EPPs when you switch sides? If you do switch sides and switch to the other side's pools, what happens when you change back?
My guess is if they open up pools on the other side for heroes and villains, it wil end up in the situation of you will finally have some form of Patron AND ancillary pool for both sides. Or maybe that's one of the benefits of not switching... *shrug*

The simple answer is you don't force it. If a character switches sides before 40 they have access to the new side's EPPs. If the character already has one when they switch side then leave it alone. They may have to choose a different pool if they respec, but there's no need to force someone out of the pool they already have.
